By accessing or using BandPilot ("the Service"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing the Service. These terms apply to all visitors, users, and others who access or use the Service.
BandPilot is a cloud-based setlist management platform designed for cover bands, wedding bands, and working musicians. The Service includes, but is not limited to:
You must provide accurate, complete, and current information when creating an account. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account.
You must immediately notify us of any unauthorized access to or use of your account. We are not responsible for any loss or damage arising from your failure to comply with this security obligation.
You must be at least 18 years old and have the legal capacity to enter into a binding agreement to use the Service. By using the Service, you represent and warrant that you meet these requirements.
BandPilot offers multiple subscription tiers: Free, Plus ($29.99/yr or $3.99/mo), and Pro ($59.99/yr or $6.99/mo). Prices are listed in US dollars and may be subject to applicable taxes. We reserve the right to change pricing with 30 days notice to subscribers.
The Free tier includes unlimited songs, up to 3 setlists, 1 band, and CSV import/export. No payment information is required for the Free tier.
Subscription fees are billed in advance on a monthly or annual basis via Stripe. Your subscription will automatically renew unless you cancel before the renewal date. All fees are non-refundable except as expressly stated in these terms.
Monthly subscriptions are non-refundable. Annual subscriptions may be refunded on a prorated basis within the first 30 days. Refund requests must be submitted to support@bandpilotapp.com.
You agree not to use the Service to:
The Service, including all content, features, and functionality, is owned by BandPilot and protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our express written permission.
You retain ownership of all content you upload to the Service, including songs, setlists, lyrics, and notes. By uploading content, you grant us a limited license to store, process, and display your content solely for the purpose of providing the Service to you.
Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of your information as described in our Privacy Policy. We take data security seriously and implement industry-standard security measures to protect your information.
The Service integrates with third-party services that have their own terms and privacy policies:
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
To the maximum extent permitted by law, BandPilot shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or relating to your use of the Service, even if we have been advised of the possibility of such damages.
You agree to indemnify and hold harmless BandPilot, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these terms.
You may cancel your subscription and terminate your account at any time through the Settings page or by contacting support. Upon termination, you will retain access until the end of your current billing period.
We may suspend or terminate your account immediately if you violate these terms, engage in fraudulent activity, or for any other reason at our sole discretion with reasonable notice.
Upon termination, your right to use the Service will cease immediately. You may export your data for up to 30 days following termination. After this period, your data may be permanently deleted.
These terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions. Any disputes arising from these terms or the Service shall be resolved in the courts of Ontario, Canada.
We reserve the right to modify these terms at any time. We will notify you of material changes via email or through the Service at least 30 days before they take effect. Your continued use of the Service after changes become effective constitutes acceptance of the new terms.
